1. Introduction & Acceptance
Welcome to Peak Journey ("The Company," "We," "Us"). By accessing our website, making a payment, or booking an expedition, you ("The Client," "Participant") agree to be bound by these Terms and Conditions. Please read them carefully. If you do not agree with any part of these terms, you must not proceed with the booking.
Company Identity: Peak Journey is an Adventure Consultant Company (SSM No: 201403285366), established in November 2014. We specialize in consulting, coordinating, and delivering high-quality adventure experiences. We are distinct from a standard Travel and Tour operator; our focus is on specialized adventure logistics.
2. Booking & Payment Policy
2.1 Booking Fees & Deposits
Deposit: To confirm participation, a NON-REFUNDABLE Booking Fee/Deposit is required. The amount ranges from RM500 to RM2,000 per participant, depending on the destination.
Confirmation: Payment of the deposit constitutes your formal acceptance of these Terms and Conditions.
2.2 Payment Schedule
We offer flexible payment options to assist with financial planning:
Lump Sum: Full payment upon booking.
Structured Plans: Payment milestones at 30%, 50%, and 100% completion.
Monthly Instalments: Structured payments spread across the pre-trip period.
Final Deadline: Full payment must be cleared at least 60 days before the adventure start date.
2.3 Payment Methods & Charges
Accepted Methods: Online Bank Transfer, QR Payment, and Touch 'n Go eWallet.
Prohibited Methods: We do not accept credit card payments.
Bank Charges: The Client is responsible for all transaction fees, including international transfer fees and exchange rate differences. Peak Journey must receive the full quoted amount in Malaysian Ringgit (MYR).
Proof of Payment: Receipts/Screenshots must be emailed to peakjourney8848@gmail.com including the Participant’s Name, Trip Name, and Payment Purpose.
3. Cancellation & Refund Policy
3.1 Client-Initiated Cancellation
Peak Journey enforces a Strict Cancellation Policy.
Non-Refundable: All fees paid, including the Booking Fee/Deposit and subsequent instalments, are STRICTLY NON-REFUNDABLE regardless of the reason for cancellation (including medical emergencies, personal changes of plan, or visa rejections).
Transfer of Seat: Clients may propose a substitute participant. However, Peak Journey reserves the right to reject a substitute based on physical readiness or safety concerns. If a substitute is accepted after permits/bookings are processed, a penalty fee will apply.
3.2 Company-Initiated Cancellation
If Peak Journey cancels a trip due to operational reasons (e.g., failure to meet minimum participant numbers), a full refund will be provided, excluding the initial Booking Fee.
Refund Timeline: The refund process will commence 14 days after the originally scheduled trip date.
Peak Journey reserves the right to cancel a trip due to unforeseen circumstances (e.g., safety concerns, force majeure, or insufficient participation).
4. Force Majeure & Trip Postponement
This section governs cancellations caused by external events beyond the control of both the Client and the Company.
4.1 Definition of Force Majeure
Force Majeure includes, but is not limited to: Acts of God, war, armed conflict, civil unrest, political instability, pandemics/epidemics, border closures, natural disasters, or specific government orders.
4.2 Government Advisories & Official Postponement
Peak Journey prioritizes safety above all else. If the Malaysian Government (e.g., Wisma Putra) or the Local Authority of the host country issues a travel ban, border closure, or officially advises/recommends that travel be postponed or deferred due to Force Majeure events (including but not limited to war, civil unrest, natural disasters, or health crises):
Automatic Postponement: The expedition will be postponed to a future date. The trip is NOT considered cancelled by Peak Journey, and participants are NOT entitled to a refund.
Credit Transfer: Peak Journey will make every reasonable effort to transfer payments made to the new date. However, any non-recoverable costs already paid to local vendors (such as permits, accommodations, internal flights, or deposits) that cannot be refunded or transferred by the vendor will be deducted from the client’s credit balance.
Cost Adjustments: Participants agree to bear any additional costs for the rescheduled trip arising from inflation, increased permit fees, currency fluctuations, or logistical adjustments required for the new dates.
4.3 Voluntary Cancellation During Uncertainty
If there is no official government directive/ban, but a Client chooses to cancel due to personal fears (e.g., fear of war or political tension), the Standard Cancellation Policy (Section 3.1) applies, and no refund or credit will be issued.
5. Travel Insurance & Liability
5.1 Mandatory Insurance
Requirement: Travel Insurance is MANDATORY and is NOT INCLUDED in our packages unless specified.
Coverage Specifics: Insurance must cover high-altitude trekking/mountaineering up to the specific elevation of the expedition (e.g., coverage up to 6,475m for Mera Peak) and include emergency medical evacuation/helicopter rescue.
Client Responsibility: It is the Client’s sole responsibility to ensure their policy covers all planned activities.
5.2 Liability Release
Assumption of Risk: Clients acknowledge that adventure activities involve inherent risks, including injury, illness, or death. Participation is voluntary.
Release: Peak Journey is an adventure consultant. We act as an intermediary and are fully released from liability for accidents, negligence, injuries, delays, or losses caused by third parties (airlines, local guides) or Force Majeure events.
Rescue: Peak Journey will assist in coordinating rescue operations, but all associated costs must be borne by the Client or their insurance provider.
6. Health, Conduct & Documentation
6.1 Health & Fitness
Clients must truthfully declare all health conditions. Peak Journey reserves the right to deny participation if a condition poses a safety risk.
An indemnity and medical declaration form must be signed prior to departure.
6.2 Conduct
Peak Journey reserves the right to remove any participant during the trip if their behavior is deemed unsafe, disruptive, or illegal. No refund will be issued in such cases.
6.3 Documents
Clients are responsible for ensuring they possess a valid passport (minimum 6 months validity), necessary visas, and travel permits.
7. Equipment & Logistics
Rental Items: If Peak Journey provides rental gear (duffel bags, jackets, etc.), the Client is responsible for their care. Damaged or lost items must be compensated.
Portage: Unless otherwise stated, the Client is responsible for carrying their own gear or arranging for porters/checked baggage at their own cost.
Itinerary Changes: Hotels, routes, and flight schedules are subject to availability. Peak Journey reserves the right to substitute accommodations or alter itineraries to maintain safety and quality.
8. General Provisions
Official Communication: All official notices (invoices, cancellations, changes) must be sent via email to peakjourney8848@gmail.com. Communication via WhatsApp/Social Media is for informal coordination only and is not legally binding.
Media Consent: By participating, you consent to being photographed/filmed for promotional use. To opt-out, you must inform us in writing before the trip.
Privacy: Personal data is used solely for trip planning and emergency purposes.
Language: In the event of a dispute or translation discrepancy, this English version of the Terms and Conditions shall prevail.
Amendments: Peak Journey reserves the right to update these terms without prior notice. The version on the website is the final reference.
