These terms and conditions outline the rules and regulations for the use of Peak Journey's Website, located at https://www.mypeakjourney.com.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use Peak Journey if you do not agree to take all of the terms and conditions stated on this page.

Company Identity
Peak Journey is an Adventure Consultant Company (not a Travel and Tour Company). Our focus is to consult, coordinate, and deliver high-quality and safe adventure experiences around the world. Peak Journey was established in November 2014 (SSM No: 201403285366).

Payment Terms

  • All bank charges, including those from international transfers via bank, e-wallets, or online payment platforms, must be borne by the client.

  • All prices are quoted in Malaysian Ringgit (MYR). Peak Journey is not responsible for any loss due to currency exchange rate fluctuations.

  • We do not accept credit card payments.

  • Accepted payment methods: Online Transfer, QR Payment, and Touch 'n Go eWallet only.

  • All payments must be accompanied with proof (receipt/ screenshot).

  • Proof of payment must be emailed to peakjourney8848@gmail.com, with details of payment purpose, participant name, and trip info.

  • WhatsApp is for informal notification only. Official communication must be via email.

Booking Fee & Payment

  • A non-refundable booking fee of RM500 is required to secure a spot.

  • Peak Journey allows monthly payments or 30%/50%/100% structured payment plans before the deadline provided.

  • Clients are advised to follow the suggested payment schedule to ease planning for all parties.

  • Full payment must be made at least 60 days before the adventure date.

Cancellation Policy

  • Peak Journey reserves the right to reject or replace any proposed substitute participant if the replacement is deemed unsuitable for the adventure (e.g. due to physical readiness, health conditions, or safety concerns). The client is responsible for ensuring that any replacement meets the necessary criteria.

  • Client-initiated cancellation:

    • Booking fee (RM500) is strictly non-refundable at any time.

    • No refunds will be given for cancellations made at any time, including more than 60 days before departure.

    • If bookings for accommodation, guide, transport, permits, or other services have already been made, those costs are also non-refundable regardless of cancellation date.

    • Peak Journey reserves the right to reject or refuse any substitute participant if the replacement is deemed unsuitable for the adventure, including but not limited to physical capability, health conditions, or preparedness. The client is responsible for proposing a suitable replacement.

    • If a replacement participant is arranged after permits, bookings or documentation have been processed, a penalty for changes will apply.

    • Official cancellation or replacement notice must be via email to peakjourney8848@gmail.com. WhatsApp, call, SMS, or others are not recognized.

    • All decisions made by Peak Journey are final and conclusive.

  • Peak Journey-initiated cancellation:

    • Full refund will be provided excluding the RM500 booking fee.

    • Peak Journey reserves the right to cancel a trip due to unforeseen circumstances (e.g. safety, force majeure, minimum pax not met).

Cancellation Due to War, Conflict, or Government Orders

  • If the local or host country’s government enforces a travel ban, border closure, or officially cancels all expeditions due to war, armed conflict, or political instability, Peak Journey will postpone the expedition to a later date. Participants will not be entitled to a full refund.

  • Peak Journey will make every reasonable effort to reschedule the trip. However, any payments already made to local vendors — such as for permits, accommodations, transportation, or guiding services — that are non-refundable will be deducted from any credit or transfer to a future date.

  • Participants also agree to bear any additional costs if the rescheduled trip incurs extra charges due to inflation, new permit fees, or logistical adjustments.

If there is no official directive or restriction from the government, and a participant decides to cancel their participation due to personal concerns — including but not limited to fear of war, safety issues, or political tension — the standard cancellation policy will apply, and no refund will be issued.

Travel Insurance

  • Insurance is NOT INCLUDED in any Peak Journey package, unless it is specifically stated.

  • In the event of any accident, negligence, injury, emergency, or death, all matters will be referred to the client's insurance coverage.

  • Peak Journey shall be fully released from any liability or responsibility arising from such incidents, regardless of circumstance.

  • Clients participate voluntarily and with full awareness of the inherent risks involved in adventure activities.

  • Clients are solely responsible for their own safety and conduct at all times, and must ensure they are physically and mentally fit to participate in the adventure.

  • We will provide advice and guidance on suitable travel insurance options depending on the nature of your trip.

  • Insurance must include coverage for altitudes matching the expedition level (e.g., Mera Peak 6,475 meters must be covered to that height as stated in the policy).

  • In case of emergency, Peak Journey will assist in coordinating rescue or evacuation but this is subject to the insurance coverage purchased by the client.

  • Clients are fully responsible for ensuring their insurance covers all expedition risks. Peak Journey’s role is only to assist, not bear liability.

Adventure Participation Conditions

  • By joining any expedition, the client affirms their voluntary participation and acceptance of the risks involved.

  • The client agrees to be personally responsible for their safety and wellbeing throughout the journey and must maintain appropriate conduct and caution in all situations.

  • Participants must declare their health conditions truthfully before joining.

  • Peak Journey reserves the right to deny participation if a health condition poses a risk to the participant or others.

  • Participants must sign an indemnity & medical declaration form before departure.

  • Travel is at your own risk. Peak Journey will not be held liable for injuries, loss, or delays caused by third parties or force majeure.

Client Conduct & Responsibility

  • Peak Journey reserves the right to remove any participant from an adventure activity if their behavior is deemed unsafe or disruptive.

  • Participants are fully responsible for ensuring they have valid passports, visas, and required documents.

  • Any changes due to immigration issues or personal travel restrictions are the responsibility of the client.

Equipment & Rental Items

  • Where duffel bags, clothing, or equipment are provided as part of the Peak Journey package on a rental basis, the responsibility for carrying them (in checked baggage, with porter, or otherwise) lies fully with the client.

  • Clients are responsible for maintaining the condition of any rented items and returning them in good condition.

  • Rental items are optional. If the client chooses not to use them, it is the client’s own responsibility to ensure they have sufficient and suitable gear for the adventure.

Package Customization & Add-ons

  • Hotel, room type, activities and flights are subject to availability and may change without prior notice.

  • Peak Journey will always aim to maintain quality and safety. Alternatives of similar standard will be provided where changes occur.

Marketing & Media

  • By participating in our trips, you consent to being photographed or filmed for promotional purposes.

  • You may request not to be featured by informing us in writing prior to the trip.

Data & Privacy Protection

  • All personal data shared with Peak Journey is kept secure and used only for the purpose of trip planning, insurance guidance, and emergency contact.

Amendment of Terms

  • Peak Journey reserves the right to revise these terms and conditions at any time without prior notice.

  • The latest version will be made available on our official website.

Official Correspondence & Documentation

  • All official documents including quotations, invoices, and receipts are only valid if sent via email from peakjourney8848@gmail.com.

  • Any communication or document shared through WhatsApp or other informal platforms is considered non-official and non-final.

Language & Validity

  • In the event of any translation into Malay or other languages, the English version shall take precedence.

  • The version published on the official Peak Journey website is considered the final and binding reference.

Agreement
By making any payment or booking with Peak Journey, you are deemed to have read, understood, and agreed to these terms and conditions.
